Terms & Conditions – Tailor-Made Cycling Tour Planning (Rogonneur)

1. Provider

2. Scope

These Terms apply to the purchase and delivery of Rogonneur’s tailor-made cycling tour planning service (“Service”). The Service is a digital, custom planning deliverable created based on the information you provide via the booking form.

3. What you are buying

Rogonneur provides customized tour planning content which may include, depending on your selection and inputs:

  • Cycling route planning (e.g., GPX files and route information)

  • Accommodation suggestions with booking links and indicative price ranges

  • Food and resupply suggestions

  • Travel logistics suggestions (train/bus/flight options) and bike transport tips

  • Packing and gear suggestions

Rogonneur does not provide guided tours, on-route supervision, emergency assistance, medical advice, legal advice, or insurance.

4. Booking, contract formation, and customer duties

A binding contract is formed when you submit the booking and payment is successfully completed. You agree to provide complete and accurate information. You are responsible for assessing whether the planned itinerary is suitable for your fitness, skills, equipment, and circumstances, and for complying with all laws and rules applicable to your trip.

5. Prices and payment

Prices are displayed in EUR on the booking page. Payment is processed online. Taxes/VAT are included only if explicitly stated on the checkout page/provider invoice.

6. Delivery timeframe

After successful payment, Rogonneur will deliver your customized tour plan to you within one (1) working day at the latest, unless otherwise stated or agreed. If clarification is needed to complete your itinerary, Rogonneur may contact you using the email address provided.

7. No refunds due to customization (and statutory rights)

Because the Service is individually customized to your specifications, all sales are final and no refunds are offered once work has started and/or the customized deliverables have been prepared.

This does not limit any mandatory consumer rights that cannot be excluded under applicable law. Where applicable, you expressly request performance of the Service to begin before the end of any statutory withdrawal period and acknowledge that your right of withdrawal may be lost once performance has begun and/or the customized content has been delivered (to the extent permitted by law).

8. Safety, route accuracy, and assumption of risk

Cycling (especially multi-day touring, gravel riding, mountain riding, and bikepacking) involves inherent risks, including serious injury or death. By using the Service and following any suggested routes or recommendations, you acknowledge and accept full responsibility for your decisions and safety.

Routes, surfaces, traffic conditions, closures, weather, and access rules can change at any time. Mapping data and third-party information may be incorrect or outdated. You must independently verify route suitability, legal access, local rules, weather conditions, and safety considerations before and during your ride.

9. Limitation of liability

To the maximum extent permitted by law:

  • Rogonneur and Roger Schlecht are not liable for any loss, damage, injury, accident, delay, cost, or consequence arising from (a) reliance on the tour plan, (b) inaccuracies or incompleteness in any route, recommendation, link, or third-party information, or (c) your use of the Service and any cycling activity.

  • Rogonneur is not responsible for the availability, pricing, quality, or services of third parties (including hotels, Airbnbs, restaurants, transport providers, bike rentals, shops, or booking platforms).

  • Any liability, if legally established, is limited to the amount paid for the Service.

Nothing in these Terms excludes or limits liability for intent, gross negligence, or any liability that cannot be limited under applicable law (including certain liabilities for death or personal injury, where mandatory).

10. Third-party services and links

The Service may include links to third-party websites (e.g., booking platforms, transport providers). Those third parties operate independently and their own terms and conditions apply. Rogonneur does not endorse or guarantee third-party offerings.

11. Intellectual property and permitted use

All deliverables provided by Rogonneur (including GPX files, route descriptions, packing lists, and written recommendations) are for your personal, non-commercial use only. You may not resell, publish, distribute, or commercially exploit the deliverables without prior written permission.

12. Complaints and contact

If you have questions or issues with the Service, contact info@rogonneur.com. Rogonneur will aim to respond within a reasonable time.

13. Severability (Salvatory Clause)

If any provision of these Terms is held to be invalid, unlawful, or unenforceable in whole or in part, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid provision that comes closest to the economic intent of the original provision.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer, mandatory consumer protection rules in your country of residence may also apply. Where legally permissible, the place of jurisdiction is Freiburg im Breisgau, Germany.
